The Shared Environment takes intellectual property rights very seriously and expects others to do the same. Here you can find information about The Shared Environment’s Trademark Policy, how you may or may not use our trademarks, and how we protect them.

At The Shared Environment (“we,” “us,” “our”), we value creativity and fair business practices. We also take the protection of intellectual property rights very seriously and expect others to do the same. The Shared Environment marks (our “Marks”) are important assets and help consumers identify our brand. We also want to ensure that users of The Shared Environment platform understand how to refer to our Marks appropriately. The Shared Environment’s Trademark Policy explains how you may and may not use our trademarks, and how we protect them.

By using The Shared Environment, you agree to comply with this policy, our Intellectual Property Policy, and all applicable laws regarding trademarks and intellectual property. 

The Shared Environment Marks (our “Marks”) refers to all words, logos, graphics, icons, designs, trade-dress, and other indications that identify The Shared Environment as the source of any product or service (whether in the U.S. or internationally). For example, the familiar “The Shared Environment single line” logo and the name “The Shared Environment” are examples of our most important assets. We are proud of the effort and resources that went into our branding; thus, it is our job to protect our trademarks, brand, and reputation. The Marks are owned by The Shared Environment, LLC and protected in the U.S and internationally. 

Talking about The Shared Environment

You are free to mention The Shared Environment in a factual, descriptive, or editorial capacity (e.g., “I purchased from The Shared Environment” or “I am a seller on The Shared Environment”). When you refer to The Shared Environment, please spell and capitalize it correctly. You may also link to our website, your storefront, or your account on our platform. 

Directional Use or Referential Use

You may also use The Shared Environment as part of a link or badge such as “Visit my shop on The Shared Environment” as long as it is clear you are not part of or endorsed by us and your branding remains distinct. Use of The Shared Environment in social media posts, blog posts, podcasts or videos discussing The Shared Environment platform is acceptable, provided you follow this policy and any applicable guidelines. 

We appreciate your enthusiasm as it relates to The Shared Environment and our Marks, but certain uses of The Shared Environment Marks can go too far and cause confusion as to source, affiliation, and/or sponsorship. You may not use our Marks in any way that could mislead others into believing you are employed by, represent, are endorsed by, or otherwise affiliated with The Shared Environment. 

Our Marks also shouldn’t be the main feature of your name, logo, website, or product branding. You may not alter or modify our trademarks in any way, such as by changing colors, adding words, or combining them with other marks. Our Marks may not be used in domain names, URLs, or subdomains that suggest affiliation or endorsement. Likewise, you may not use our trademarks, logos or intellectual property on promotional items or merchandise without our prior written consent. You must not mimic our website’s design or replicate our brand identity in a way that could cause confusion about whether your site or content is official. Finally, our Marks may not be used in advertising, search keywords, or metadata in a manner that implies sponsorship or partnership with The Shared Environment.

We love that The Shared Environment users organize events, form user groups, or host communities. However, we need to ensure how our Marks are being used. If you organize events, create merchandise, form user groups, or host communities that reference The Shared Environment, you must make it clear that you are not officially affiliated with or endorsed by The Shared Environment, unless you have an explicit written agreement with us. Our Marks must not be the dominant visual or naming element of the event, merchandise, or group, and your own branding should take precedence. You may use our name in the title or promotional materials, only if the overall presentation makes clear that you are independent of and only referencing The Shared Environment. If you use our Marks on merchandise, you must obtain The Shared Environment’s prior written consent. 

The Shared Environment strives to respond quickly by removing or disabling access to the allegedly infringing material when we receive a report of intellectual property infringement that complies with our policies. 

If you believe one of our Marks are being used in a confusing or infringing way, please contact us at legal@thesharedenvironment.com. We will review claims of misuse, and reserve the right to require correct action, revoke any permitted use, or pursue legal remedies.

The Shared Environment terminates selling privileges of members who are subject to repeat or multiple notices of intellectual property infringement in appropriate circumstances and at The Shared Environment’s discretion. If we believe a member has attempted to open a new shop after termination of the initial account, we reserve the right to refuse all services to that member. These actions apply to any accounts we believe are associated with or operated by the affected member. Per our Terms, The Shared Environment reserves the right to terminate account privileges at any time, for any reason, and without advance notice.

The Shared Environment only accepts withdrawals of infringement reports directly from the intellectual property owner or authorized representative who submitted the claim. The withdrawal must clearly state that it is a formal withdrawal and sufficiently identify the member and/or material.

Once The Shared Environment receives a formal withdrawal of an infringement report, The Shared Environment will contact the withdrawing party to confirm receipt and will notify the affected member of the withdrawal. Please note that infringement matters are reviewed on a case-by-case basis, and withdrawals do not guarantee changes to a member's shop status.

9. Consequences of Non-Compliance

If you fail to follow this policy, The Shared Environment may take action. Per our Terms, The Shared Environment reserves the right to terminate account privileges at any time, for any reason, and without advance notice.

Changes to this Policy

The Shared Environment reserves the right to modify this Trademark Policy at any time. Changes will become effective when posted on The Shared Environment site (or otherwise communicated). Your continued use of our services after changes are posted constitute your acceptance of the revised policy.
