1. MARKETPLACE STRUCTURE AND DATA ROLES

The Shared Environment is a marketplace platform, not the seller of record for most goods listed on the Services.

1.1 Sellers as Independent Businesses

When you purchase a product through the Marketplace, the transaction is between you and the Seller. Sellers operate independently and may process personal information to fulfill orders, provide customer service, comply with legal obligations, and operate their businesses.

1.2 Separate Data Controllers

Sellers process your personal information independently as separate controllers.

To enable Marketplace transactions, we share certain Buyer information with Sellers.

Sellers may only use Buyer information for purposes such as:

Marketplace-related communications

Sellers are prohibited from using Buyer data for unrelated marketing or selling it to third parties except as permitted by law.

The Shared Environment is a marketplace platform, Sellers fulfilling orders may be located outside of the United States, and we may share certain personal information with those Sellers in order to complete transactions.

communications necessary to fulfill the order.

As a result, your personal information may be transferred internationally in connection with Marketplace transactions.

Where required by applicable law, we rely on appropriate safeguards for cross-border transfers, such as:

Standard Contractual Clauses or equivalent mechanisms; and

By using the Services and placing an order, you understand that your personal information may be transferred to Sellers and partners located in other countries as necessary to provide the Marketplace Services.

10.3 No Sale or Sharing for Targeted Advertising

The Shared Environment does not sell personal information. We also do not share personal information for cross-context behavioral advertising or targeted advertising purposes. We use only strictly necessary cookies and limited analytics tools to understand Marketplace performance and improve the Services.

10.4 Exercising Privacy Rights

Depending on your state of residence, you may have the right to request:

This California Privacy Notice supplements the Privacy Policy of The Shared Environment LLC (“The Shared Environment,” “we,” “us,” or “our”) and applies solely to individuals who reside in the State of California (“Consumers”) as required under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CPRA”).

Appendix B - CANADA PRIVACY ADDENDUM

This Canada Privacy Addendum supplements the Privacy Policy of The Shared Environment LLC and applies to individuals located in Canada whose personal information is processed through the Marketplace.

The Shared Environment processes personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and substantially similar provincial laws.

1. Consent

By using the Services or making a purchase, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

In some cases, you may withdraw consent, subject to legal or contractual restrictions, by contacting us as described below.

2. Use and Disclosure

We collect and use personal information to:

operate the Marketplace;
facilitate transactions between Buyers and Sellers;
provide customer service;
comply with legal obligations; and
improve and secure our Services.

Appendix C – SELLER PRIVACY OBLIGATIONS

This Appendix forms part of the Seller Agreement and applies to all Sellers operating on The Shared Environment Marketplace.

Sellers acknowledge that they may receive personal information about Buyers in order to fulfill Marketplace transactions.

1. Permitted Use of Buyer Information

Sellers may use Buyer personal information only as necessary to:

Fulfill and ship orders
Provide transaction-related customer support
Communicate with Buyers regarding the purchase
Comply with applicable law (tax, consumer protection, recalls)

Sellers may not use Buyer personal information for unrelated purposes.

2. Prohibited Uses

Sellers are strictly prohibited from:

Selling Buyer personal information
Using Buyer information for unsolicited marketing
Collecting Buyer data outside the Marketplace systems
Sharing Buyer information with third parties except fulfillment vendors
Retaining Buyer information longer than necessary

3. Seller Role as Independent Data Controller

Sellers acknowledge that they process Buyer personal information as independent controllers under applicable privacy laws.

Sellers are solely responsible for:

Their own privacy compliance
Responding to Buyer rights requests where required
Maintaining an appropriate privacy notice if legally required

4. Data Security Requirements

Sellers must implement reasonable administrative, technical, and physical safeguards, including:

Restricting access to order data
Secure storage of Buyer communications
Avoiding unencrypted transmission of personal data
Prompt reporting of suspected breaches

5. Data Retention and Deletion

Sellers may retain Buyer personal information only as long as necessary for:

Order fulfillment
Warranty/support periods
Legal compliance obligations

Upon termination of Seller access, Sellers must delete Buyer personal information unless retention is required by law.

6. Breach Notification

Sellers must notify The Shared Environment immediately (and no later than 72 hours) if they become aware of:

unauthorized access
loss or misuse of Buyer personal information
any security incident involving Marketplace data

7. Enforcement

Violation of these privacy obligations constitutes a material breach and may result in:

suspension
termination
legal action
indemnification obligations
