Prohibited Items Policy
This Prohibited Items Policy (“Policy”) forms part of the Terms and outlines the categories of items that may not be listed, sold, or promoted through our Services. Sellers are responsible for ensuring that all items they offer comply with this Policy and with all applicable laws, regulations, and standards in every jurisdiction in which their products are made available. Our aim is to create a safe, legal, and trustworthy marketplace for Montessori materials and related products. This Policy covers not only items that are illegal but also those that do not align with our community values, infringe on intellectual property rights, or pose a safety risk to our users, especially children. Capitalized terms used but not defined here have the meanings given in the Terms.
1. Illegal or Restricted Items
Sellers may not list items that are illegal, restricted, or prohibited under applicable laws. This includes items that cannot legally be possessed, sold, transported, or distributed. Examples include weapons, illicit drugs, stolen goods, items promoting illegal activity, and products derived from protected species.
Platform Review Disclaimer
While The Shared Environment may monitor, review, or remove listings as part of its enforcement of this Policy, we do not guarantee that all prohibited or unlawful items will be identified or prevented from appearing on the marketplace. Our review or failure to remove a listing does not constitute approval, endorsement, or assurance that an item is legal, safe, or compliant. Sellers remain solely responsible for ensuring that all products offered through the Services comply with this Policy and applicable law.
2. Unsafe or Hazardous Items
Sellers may not list items that pose unreasonable or unacceptable safety risks. This includes:
a. Products that fail to meet applicable product safety laws, regulations, or standards.
b. Items containing hazardous substances or materials exceeding legally permitted levels.
c. Products presenting choking, ingestion, flammability, sharpness, or structural hazards.
d. Items subject to a government-issued recall or safety notice. Sellers must promptly remove and notify the platform if an item becomes subject to a recall, safety alert, or regulatory investigation.
Sellers listing children’s products into the UK must comply with all applicable product safety laws, including Toy Safety Regulations 2011 and UKCA/CE marking requirements where applicable.
3. Intellectual Property
Sellers may not list items that infringe upon the rights of others. Prohibitions relating to copyrights, trademarks, patents, and other intellectual property appear in the Terms and apply equally to all listings on the Services.
4. Content Inconsistent with Platform Standards
Items containing or promoting prohibited content, including offensive, hateful, violent, or adult content, are not permitted. Content restrictions and platform values applicable to all user conduct and listings are described in the Terms.
5. Items Not Appropriate for the Services
The Shared Environment focuses on Montessori materials, educational items, and related goods. Items that fall outside the scope of the marketplace, or that conflict with the intended purpose of the Services, may be removed at our discretion.
6. Region-Specific Restrictions
Sellers are responsible for understanding and complying with all regional, national, and local restrictions that may apply to their products, including import, export, labeling, and safety requirements. Listings not compliant with such requirements may be removed.
7. Enforcement
Enforcement procedures, consequences for violations, and the platform’s rights concerning account actions are outlined in the Terms and apply equally to violations of this Policy. The Shared Environment may remove any listing, suspend access, or take other actions it deems appropriate in its sole discretion. We may require safety certifications, licences, testing documentation, or supply chain records at any time. Failure to provide such information may result in immediate suspension or listing removal.
8. Reporting
Users may report prohibited or unsafe items through the channels provided in the Services. The Shared Environment may review reported items and take appropriate action in accordance with the Terms and this Policy.
This Policy may be updated periodically. Continued use of the Services constitutes acceptance of any updated version of this Policy.
