Product Safety Policy

The Shared Environment connects independent sellers and buyers of Montessori materials, children’s items, furnishings, and other goods. Because many items offered through our Services may be classified as children’s products, maintaining product safety is essential. This Product Safety Policy outlines the responsibilities of Sellers relating to product safety, compliance, and incident reporting. By using our Services, Sellers agree to comply with this Policy.

1. Seller Responsibility for Product Safety and Compliance

a. Primary Responsibility

Sellers are solely responsible for the safety, quality, and compliance of all products they list or sell through our Services. This includes ensuring that products are safe for their intended use and meet all applicable product safety laws, regulations, and standards in every jurisdiction in which they are sold, shipped, or marketed.

b. Compliance with Applicable Laws

Sellers must ensure that all products comply with all applicable legal requirements relating to product safety, including requirements governing children’s products, toys, furnishings, labeling, warnings, age grading, chemical content, and packaging. Sellers are responsible for determining which laws apply to their products and maintaining compliance at all times.

c. Materials and Components

Sellers must ensure that all materials, finishes, and components used in their products comply with applicable safety requirements, including those relating to hazardous substances or potential risks to children.

d. Age Grading and Warnings

Sellers must provide accurate age grading, warnings, and any required safety instructions in accordance with applicable laws. Such information must appear on the product or packaging and must be clearly disclosed in the product listing.

e. Testing and Documentation

Where applicable laws require testing, certification, or other compliance documentation, Sellers must complete all required testing prior to listing a product and retain all related records. Sellers must provide such documentation to The Shared Environment upon request.

2. Product Recalls and Safety Incidents

a. Seller Notification Requirements

Sellers must promptly notify The Shared Environment via our Help Desk if they become aware of any actual or potential safety issue, regulatory inquiry, or product recall relating to items they have listed or sold through our Services.

b. Seller Responsibilities

If a recall or other safety action is required under applicable law, Sellers are responsible for carrying out all legally required steps, including removing affected products from sale, notifying impacted customers, and providing any remedies required by law.

c. The Shared Environment’s Rights

The Shared Environment may, at its sole discretion, remove or disable access to affected listings, notify users, or take any other action it deems appropriate to protect the integrity of the Services or comply with legal obligations.

3. Documentation and Record Keeping

Sellers must maintain all documentation required under applicable law, including testing records, certifications, and safety-related communications. Sellers must retain these records for the period required by law and provide them to The Shared Environment upon request. Failure to provide documentation may result in listing removal or suspension of account access.

4. Enforcement

The Shared Environment may monitor Seller compliance with this Policy. Failure to comply with this Policy or any applicable law may result in listing removal, account suspension, termination, or other actions permitted under the Terms or applicable law. These remedies are in addition to any other rights or remedies The Shared Environment may have.

5. Disclaimer

This Policy supplements, and does not limit, a Seller’s independent legal obligations. The Shared Environment does not design, manufacture, store, or inspect items sold through the platform and makes no warranties regarding the safety, compliance, or legality of Sellers’ products. Any claims relating to product safety, defects, or non-compliance must be directed to the Seller in accordance with our Terms.
