Copyright Policy

The Shared Environment takes intellectual property rights very seriously and expects others to do the same. Here you can find information about The Shared Environment’s copyright policy, how to report copyright infringement, and how to respond to a copyright notice.

The Shared Environment complies with the Digital Millennium Copyright Act (DMCA) and responds to claims of copyright infringement using DMCA procedures, including the law's process of notice and counter notice for claimed copyright infringement:

  • If The Shared Environment receives what it reasonably believes to be a complete and valid notice of alleged copyright infringement regarding content on a store, then it will generally remove the reported content from its platform and will inform the affected member via the seller portal.
  • The Shared Environment may request additional information before processing a report, such as a letter of authorization from the rights owner, identity verification of the reporting party, or other documentation regarding the claimed right. 
  • The Shared Environment will give the member an opportunity to send a counter notice explaining why they think the content was removed in error. If the counter notice is valid, then a member will generally be allowed to repost the content in 10 to 14 business days.
  • In some instances, The Shared Environment may decline to remove the reported content or, if it has been removed, allow the member to repost the content immediately.
  • The Shared Environment has a policy of terminating members for repeat infringement in appropriate circumstances, such as where it has received several notices of alleged infringement that are not countered by the member. When a member is terminated for repeat infringement, all shops that are owned or operated by the same repeat infringer are also subject to termination.
  • The Shared Environment retains discretion to disable members for even a single instance of willful or egregious infringement.

The submission of false or bad faith notices of claimed infringement or counter notices is punishable by law. Those harmed by such notices, including The Shared Environment itself, may sue for damages and attorneys' fees. Submission of false or bad faith notices of claimed infringement is punishable by law. The Shared Environment also reserves the right to take action against abusers of this policy.

To report infringement to The Shared Environment’s designated agent, please send a notice of infringement via email to dmca@thesharedenvironment.com, which must include all of the following information to take action:

  • Your legal name and contact information.

  • Direct links to the original copyrighted work claimed to be infringed. If you don't have a direct link, then you can provide a sufficient description of your work.

  • Direct links to the specific content on The Shared Environment that you believe infringes your copyright. A list of each individual page containing the content is required. A general shop link will not be accepted.

  • Sufficient description of the content that you believe infringes your copyright and where it appears in the link, such as which images, videos, gifs, and text.

  • Confirmation you have a good faith belief that use of the content in the manner complained of isn't authorized by the copyright owner, its agent, or the law.

  • Confirmation all of the information in the notice is accurate.

  • A statement, under penalty of perjury, that you're the copyright owner or are authorized to act on behalf of the owner.

  • Your physical or electronic signature.

Note

A copy of any notice that you submit, including any contact information provided, may be provided to the person that posted the content being reported.

If you misrepresent that material is infringing, you may be liable for damages (including costs and lawyers' fees). Therefore, if you are not sure whether the material is infringing, please contact a lawyer before submitting a notice to The Shared Environment. Fraudulent or abusive notices or other misuse of The Shared Environment’s Intellectual Property Policy may result in member termination or other legal consequences.

When The Shared Environment receives a DMCA counter notice, we will provide a copy of the counter notice to the original complaining party. The removed material may be replaced or access to it may be restored 10 business days after the counter notice is processed, unless the copyright owner files an action seeking a court order, and informs The Shared Environment of this action.

If The Shared Environment receives what it reasonably believes to be a complete and valid notice of alleged copyright infringement, then you'll get a notification letting you know. You then have two options:

  • If you review the notice and agree you don't have the right to use the content, then no further action is necessary. The Shared Environment will remove the content and it will remain offline unless you receive approval from the copyright holder.

  • If you review the notice and believe the content was removed as a result of mistake or misidentification, then you can file a DMCA counter notice.

You can send a counter notice to us via email to dmca@thesharedenvironment.com, which must include all of the following information to be considered:

  • The legal name and sufficient contact information of the person submitting the counter notice.

  • Identification of the content that has been removed and the original location of the content before it was removed.

  • A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located or, if your address is located outside of the United States, you consent to jurisdiction of the Federal District Court for the District of Delaware.

  • A statement that you will accept service of process from the party who submitted the copyright notice or its agent.

  • A statement under penalty of perjury that you have good faith belief that the content was removed as a result of a mistake or misidentification.

  • Your physical or electronic signature.

When you submit a valid counter notice, we'll remove the complaint from your The Shared Environment account record and send a copy of your counter notice to the party that submitted the copyright notice. If they take legal action against you and send us notice of that action within 10-14 business days, then the content may remain down. If we don't receive notice of legal action within that period, then we'll notify you and the disputed content may be reposted.

The Shared Environment terminates selling privileges of members who are subject to repeat or multiple notices of intellectual property infringement in appropriate circumstances and at The Shared Environment’s discretion. If we believe a member has attempted to open a new shop after termination of the initial account, we reserve the right to refuse all services to that member. These actions apply to any accounts we believe are associated with or operated by the affected member. Per our Terms, The Shared Environment reserves the right to terminate account privileges at any time, for any reason, and without advance notice.

The Shared Environment only accepts withdrawals of infringement reports directly from the intellectual property owner or authorized representative who submitted the claim. The withdrawal must clearly state that it is a formal withdrawal and sufficiently identify the member and/or material.

Once The Shared Environment receives a formal withdrawal of an infringement report, The Shared Environment will contact the withdrawing party to confirm receipt and will notify the affected member of the withdrawal. Please note that infringement matters are reviewed on a case-by-case basis, and withdrawals do not guarantee changes to a member's shop status.

This Policy may be updated periodically. Continued use of the Services constitutes acceptance of any updated version of this Policy.
